Understanding the EU Data Act

The EU Data Act (Regulation (EU) 2023/2854) introduces harmonised rules for fair access to and use of data within the European Union. For companies operating in the automotive sector, such as car dealerships, resellers, and sales intermediaries, the regulation is particularly relevant as vehicles and related services generate large amounts of valuable data.

Adopted on 13 December 2023 and applicable from 12 September 2025, the Data Act aims to ensure that data generated by connected products — including modern vehicles — can be accessed and used in a fair, transparent, and secure way.

How it relates to the automotive industry

Modern vehicles are increasingly “connected”, collecting data on performance, maintenance, usage, and driver behavior. Under the Data Act, such data should be made available to users — such as car owners or fleet operators — and, where authorised, to third parties like repair shops, leasing companies, or resale platforms.

  • Dealers and intermediaries can offer data-driven services, such as predictive maintenance or vehicle history verification, in compliance with EU rules.

  • Provide clear information to customers about what vehicle data is collected and how it can be accessed.
  • Ensure that data access for customers and third parties is technically possible and non-discriminatory.
  • Review contracts with data processors and service providers (e.g. telematics, insurance, or maintenance partners) to ensure compliance with the Data Act.
  • Protect trade secrets and commercially sensitive data while enabling legitimate data sharing.
  • Support interoperability and switching between digital service providers (e.g. connected car platforms or cloud systems).

The regulation gives customers more confidence when buying or servicing vehicles, as data access becomes a right, not a privilege. For intermediaries and resellers, it opens new opportunities to build trust through transparent data handling and improved after-sales services.
